ClaimArmy ("ClaimArmy," "we," "our," or"us") is committed to protecting your privacy and handling your personal information responsibly and transparently.   • Professional details for advocates: credentials, certifications, licenses, professional experience.
  • Payment information: billing details, credit card or payment information (securely processed by third-party payment gateways, not stored by ClaimArmy).
  • Any other personal information you voluntarily provide.

Other Information:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log     data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports     (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

How much information we collect depends on the type and settings of the device you use to access the Services.   • To vetted advocates for the sole purpose of providing the requested services.
  • To third-party vendors necessary for the operational support of our business (e.g., payment processors, cloud providers), bound by confidentiality obligations.
  • When required by law, court orders, or regulatory authorities.
  • To protect ClaimArmy’s rights, safety, and property.

HIPAA and PHI Compliance

Advocates represent and warrant that:

  • They are knowledgeable about and fully comply with all applicable federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA).
  • They utilize best practices and maintain comprehensive policies to secure PHI and personal data.
  • They immediately notify ClaimArmy of any suspected or actual unauthorized access or breach involving PHI.

ClaimArmy explicitly forbids any use of our platform or services for exchanging, sharing, storing, or transmitting PHI. Any violation of this policy will result in immediate termination of access and may invoke legal action.

Security Measures

ClaimArmy employs industry-standard administrative, technical, and physical safeguards to protect the information collected from unauthorized access, use, disclosure, alteration, or destruction.

Data Retention

ClaimArmy retains your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

By using ClaimArmy’s services,including accessing our website or engaging as an advocate or customer, you("User") agree to these Terms of Service ("Terms"). Please read these Terms carefully.

Eligibility and Registration

  • Advocates must maintain appropriate credentials, licenses, and insurance.

User Conduct and Responsibilities

Users agree not to:

  • Share, upload, or transmit PHI via ClaimArmy services.
  • Engage in unlawful, harmful, or fraudulent activities.
  • Violate any applicable local, state, or federal laws.

Advocate Obligations

Advocates represent and warrant:

  • Compliance with HIPAA and all other applicable laws regarding PHI and data privacy.
  • Implementation of best practices to secure and protect customer information.
  • Immediate reporting of any data breaches or compliance issues.

Payments and Fees

Users agree to pay applicable fees clearly disclosed prior to service initiation. All payments are securely processed through third-party gateways.

Intellectual Property

ClaimArmy retains exclusive ownership of all intellectual property related to its services and platform. Users may not reproduce, distribute, modify, or create derivative works without express written permission. Upon launch of ClaimArmy’s secure data vault, Advocate agrees to transmit ongoing and historical case files via ClaimArmy’s designated HIPAA-compliant system within 10 business days as a condition of continued marketplace access.

Limitation of Liability

ClaimArmy is not liable for indirect,incidental, consequential, punitive, or special damages arising from the use of our services. Liability for any claims shall be limited to the amount paid for services.

Indemnification

Users agree to indemnify and hold harmless ClaimArmy, its officers, employees, contractors, and affiliates from any claims, losses, or damages resulting from User actions or breach of these Terms.

Termination

ClaimArmy may terminate access to services immediately upon violation of these Terms. Users may terminate their use of services by providing written notice to ClaimArmy.

Governing Law and Dispute Resolution

These Terms are governed by and construed according to the laws of the State of Delaware, USA. Users consent to the exclusive jurisdiction of Delaware courts for dispute resolution.

General Provisions

  • These Terms constitute the entire agreement between ClaimArmy and Users.
  • No waiver of Terms shall be valid unless written and signed.
  • If any provision is deemed invalid, remaining provisions remain enforceable.
